Telehealth & Clinical Responsibility Agreement
The short version
- For all providers. You sign it in setup step 4, Agreements.
- Materia+ is a software platform, not a health care provider.
- You're responsible for your clients' informed consent, confirming who they are and where they are, handling emergencies, and holding the licences your practice needs.
- Materia+ can't locate clients or contact emergency services during a visit.
- Video visits are provided "as is". Calls can drop.
1.Materia+ is a software platform
We provide the technology. You provide the care.
Materia+ is a technology platform and doesn't provide medical care, diagnosis or treatment. The services, consultations, assessments and care plans you provide through Materia+ are your own. They are therapeutic and wellness services, not the practice of medicine, and they don't replace a client's relationship with their doctor. You practise independently and are solely responsible for practising within your legally authorized scope.
2.Informed consent
Getting your clients' consent is your job.
You're responsible for getting each client's informed consent to your services, including consent to receive care by video, and any other consent your profession or the law requires. Materia+'s Telehealth Consent, which patients accept when they book, doesn't replace your own consent process.
3.Identity and location
Confirm who your client is and where they are.
At the start of each video visit, you're responsible for confirming your client's identity and where they are. You need their location to make sure you're allowed to practise there (Provider Terms section 9) and to direct emergency services if needed. If you can't practise where the client is, cancel or end the visit.
4.Emergencies
Materia+ can't locate clients or send help. Emergencies are yours to manage.
Materia+ has no duty or ability to locate users, step in during a mental health or medical crisis, or contact emergency services during a visit. If a client has a medical emergency or a mental health crisis during a video visit, managing it is the responsibility of you and the client.
5.Licensing
Hold the licences you need where you and your client are.
You confirm that you hold and will keep every licence, registration, certification and insurance your practice requires, both where you are and where your client is during each visit. If you practise an unregulated discipline, you confirm that you follow the laws that govern your practice where you work.
6.Video technology
Provided "as is". Calls can drop.
Video visits run on the Amazon Chime SDK, part of Amazon Web Services, with call media handled in AWS's Canada (Central) region in Montreal. Materia+ provides its video tools "as is" and "as available". To the extent the law allows, Materia+ isn't responsible for dropped calls, interruptions, technical problems or delays caused by internet connections, devices, browsers or networks. Visits aren't recorded by Materia+. Don't record a visit without your client's agreement and unless the law where both of you are allows it.
7.Responsibility for your care
Claims about your care are yours.
To the extent the law allows, Materia+ isn't responsible for claims about clinical negligence or malpractice that arise from your care, advice or conduct, or from your use of the Platform. Provider Terms section 17 applies to those claims.
