Canadian Homeopathy Wellness Group is trade name and a registered trademark of Homeopathic Healing Inc. Homeopathic Healing Inc. its affiliates and subsidiaries (referred to as “Canadian Homeopathy Wellness Group,” “Homeopathic Healing,” "we", "us", or "our") are in the services of connecting, community, and facilitation. Our website (referred to as "Platform" or "Site") is a platform by which we use to facilitate information and community through services we offer (referred to as "Services"). We also work hard to provide text and video-based information from around the world about natural, miasmatic healthcare that includes original content (referred to as "Our Content") as well as third-party content.

This Terms of Use Policy (referred to as "Terms of Use Policy", "Terms", "Terms of Use", "Terms & Conditions Policy") highlights the terms by which is necessary to conduct any usage within our Platform and Services and acts as the legal ground that everyone must adhere to and follow. Please note that any disclaimers on this page are also included as a part of this policy.

Canadian Homeopathy Wellness Group has certain terms and conditions that can be found in this Terms of Use Policy that have to be addressed and acknowledged by all users of the Platform and Services (including visitors to the Platform and Services). We highly recommend you read this policy before any form of usage within the Platform, or any usage affiliated with the Platform.



2. USE OF PLATFORM


Our Platform contains content that is comprised of both Our Content and third-party content, and will include photos, designs, information, videos, policies, and material otherwise that constitutes as "content".

 

a. Content from third-party sources

We are an entity that shares content which we deem necessary to share with our different users (referred to as "You," "User," and "Users" henceforth) on our Platform and Services. All content, unless stated otherwise, is information from third-party sources and therefore falls under the responsibility of the user to take up any legal action with that third-party. These third parties can include other websites, firms, organizations, as well as providers (refer to 'Healthcare Providers' defined in our Privacy Policy) using our services. We therefore do not hold liability for any information depicted and stated by these third parties. We always state respective sources with any information we provide, but in the events that you cannot find and would like to acquire sources for certain information, please contact us and we will connect you to the appropriate source(s).

 

b. Information from us

Any information provided as a first-party source is property of Homeopathic Healing Inc. which is subject to all applicable intellectual property law, including copyright (please refer to Copyright Disclaimer).

 

c. Cookies and third-party extensions

Using our Platform (this includes Services within the Platform) means you are agreeing to certain Cookies and third-party extensions that are used to enable a better experience for our users. Our Platform uses analytical extensions to map and record usage statistics. This extends to measurements that include the volume, traffic and activity of users using the Platform. 3. USE OF SERVICES

The services we are offer are comprised of community initiative services and digital solutions.

a. Events

We are responsible for organizing events for our Advocates and other Users. These events are planned by associate professional planners and involve an array of premises under the health & wellness industry umbrella.

 

Insurance and Liability

All third-party venues used for our events are responsible for the legal care of attendees under the respective contractual agreement. Although we make careful and critical examinations of all third-party venues, we take no responsibility for the insurance and liability practices of a third party venue and or any of their affiliates (please refer to our Liability Disclaimer)

We are not responsible for insurance and liability coverage for any associates of us. Associates are required to have their own insurance and liability coverage.

We are not liable under any circumstances for any reason to any User, Associate, entity or Field Professional. Be advised that some of our events are presented as a means of learning and should be perceived as such and that by attending any of said events you agree to be responsible for any action you decide to take using the information received and learned within these events.

 

b. Seminars

We provide and facilitate lectures, presentations, and seminars (all under 'Seminar' or 'Seminars' henceforth) that cover a wide variety of topics and discussions on current affairs relating to Homeopathy and or other health related subjects. 

 

Use of third-party software

We use third-party software to conduct online seminars. Information regarding the software used during a seminar will be provided via the registration process.

 

Technical Requirements and Issues

Attendees are responsible for pertaining to their own technical requirements and issues during seminars. For any questions regarding technical requirements or technical support, please refer to the respective technical guidelines offered. We will try to accommodate individuals to the best of our ability. 

 

Lecturers and Intellectual Content

The content of seminars is provided by associate Field Professionals (within the premises of Seminar Services they are referred to henceforth as "Lecturers," or "Lecturer"). All intellectual content provided by lecturers is the sole responsibility of the lecturer and is guided by the terms of the contract entered with us.

 

Release Agreement

Most of our seminars are recorded. This is done for security purposes, and therefore all attendees automatically agree to being recorded on audio format. Video recordings of hosts and participants in the seminars can and may be used for media purposes under strict consent from any individual seen in said footage. 

 

Piracy and other forms of theft

We own all distribution rights to any seminars organized, facilitated, or otherwise displayed under our name, and therefore any distribution of contents of seminars under our name that is outside of our control is illegal and will be considered a criminal act in accordance with our Copyright Disclaimer.

Our social health platform service (named "Materia Faction") will include other individuals who are organizing and displaying their own seminars using tools accessible within our Platform and Services, in which case we do not own the content they provide; any seminars not under our name is considered third-party content. If any content in question does not follow the code of conduct and the terms stated within this policy, we hold the right to remove it from the Platform and or Services.

Any information taken from seminars on our Platform and Services for any commercial purposes must provide credit to any respective sources that will be included in seminars. To avoid any plagiarism and or any copyright infringement, we strongly advise contacting us prior to publishing the information in question publicly. Please refer to Canada's laws on plagiarism, intellectual property, and copyright.

 

Liability

We are not liable for any misinformation, misusage, or any misinterpretations of the contents of the seminars. Be advised that our seminars are presented as a means of learning and should be perceived as such and that by attending any of our seminars you agree to be responsible for any action you decide to take using the information received and learned from the seminars. Seminars do not represent a replacement from seeking professional medical and or otherwise services.

 

c. Remport, Marketplace services

Our marketplace services and clinic management service, Remport, are built for patients to provide easy and engaging access to alternative medical providers and information in Canada and provide holistic healthcare providers with clinic management & marketing solutions. The marketplace includes information about these providers and their businesses. The marketplace displays providers that are using our Remport service.

 

Patient Confidentiality

Patient confidentiality laws in Canada are very strict. We therefore take all the appropriate measures needed to ensure our compliance with said applicable laws. 

 

Communication and Interaction

Any interaction and or communication between Users; specifically, user and business is not monitored by us unless stated. Any interaction and or communication undertaken and facilitated only through and on the Platform is archived for safety and security purposes.

 

Health Information

Any health information shared with a provider through the Platform by a User becomes their sole responsibility of ensuring that it is kept confidential under applicable laws. We do not collect personal health information (“PHI”) within our Site and Services. If you have reason to believe your PHI is being shared with other parties on a non-consensual basis, you should contact the CMPA or other related authorities immediately.

Please refer to our Privacy Policy for further information on our privacy practices regarding the personal data we collect.

 

Ownership of marketplace and its contents

The marketplace and profiles on the marketplace are property of Homeopathic Healing Inc. All designs used for marketplace profiles remains the sole and exclusive property of Homeopathic Healing Inc. and cannot be transferred to any other domain or entity without our express written consent.

We do not own any of the businesses that are a part of our marketplace nor do these businesses work under us in any way, shape, or form. These businesses are independent in their practices, models, approaches, ethics, and policies. We are not liable for any activities carried out by these businesses. If any businesses under our marketplace display any form of misconduct, false practices, or any illegal activity, please contact us immediately.

 

Termination

We reserve the right to disable access and terminate accounts that are connected to our marketplace. Reasons for termination include but are not limited to;

  • Harassment of users
  • Fraudulent activity
  • Professional practices that go against Canadian Homeopathy Wellness Group's health ethics (e.g. injection of substances, serums, etc.)
  • Professional practices that deviate from miasmatic definitions of cure
  • Criminal activity

 

Liability

The businesses under our marketplace are third-party businesses. We are not responsible for third-party business practices and are not liable for actions carried out by any third parties. If a User has complications that involve these businesses, they are expected to contact these third parties directly.

 

Security and Safety

To secure a safe environment for all Users, we ask Users to be respectful to the different business practices that come with every business on our marketplace. If another entity takes information pertaining to the providers on the marketplace and uses it for their own directory/listing of healthcare providers without the consent of the provider, we will consider such an act as an act of theft; including identity theft within applicable law and we will act against said violations. We do not tolerate harassment of any kind and urge to report any such behaviour directly to us.

Some businesses offer their personal information on our marketplace and said information should be respected and void of any harassment. With any complaint or reported activity, we will act as judiciaries when deciding what is fair or unjust with the behaviour in question and we promise to remove any threats to safety and security accordingly thereafter.


d. Materia Wire

Materia Wire refers to our publication. Individuals are invited to submit written content relating to natural health and medicine subjects for review. Publications that appear on Materia Wire are reviewed by Homeopathic Healing Inc. upon submission.

 

Intellectual Property

The opinions expressed in the contents of these publications are the sole responsibility of the authors, and do not necessarily reflect the opinions of Homeopathic Healing Inc.

 

Liability

We are not responsible for material viewed within any written publication; this relates to both the appropriateness level of material viewed as well as any other impact said material has on viewers. It is the sole responsibility of the consumer to perform due diligence before reading or viewing, and as a result we cannot be held liable for any material consumed in Materia Wire. We are in the business of relaying information we believe our readers should be presented with.

 

Conduct

Harassment and any misconduct will not be tolerated on our Platform and any of our Services.

 

 

4. ACCOUNTS & MEMBERS

Access to the entire experience of the Platform and Services is obtainable through an 'account' (the equivalent of a membership) and is comprised of both paying members, also known “Healthcare Providers”, and non-paying members, known as free users (both of which are Users). Your access to the Platform, by which other Services become accessible, is conditional on the acceptance and compliance with this Terms & Conditions Policy.

 

a. Communication between members

We continuously encourage a safe and positive environment for any interaction and communication happening on our Platform and within our Services. As a condition of use, any communication and interaction between members, businesses, associates, and or representatives of ours, and or our affiliates will be for the purpose of communications, discussions, support and learning experiences that are informative, inclusive, and anti-discriminatory. Any of the following types of communications and interactions will not be tolerated:

 

1. To harass, abuse, threaten, impersonate or intimidate any person;

2. To post or transmit, or cause to be posted or transmitted, any Content that is libelous, defamatory, obscene, pornographic, abusive, profane, or that infringes on any copyright or other right of any person;

3. To communicate with our representatives, members, or associates in an abusive manner;

4. For any purpose (including posting or viewing Content) that is not permitted under the jurisdiction;

5. To create or transmit unwanted 'spam' to any person or any URL;

6. To create multiple accounts for any purpose other than replacing original account;

7. To post copyright Content that does not belong to you, unless given permission by copyright owner, provide appropriate attribution to the copyright owner and a link to the source of the Content in question.

 

b. Termination

We may terminate or suspend access to our Platform and Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. There will be a proportionate return of funds (if applicable).

When creating an account on our Platform, you hereby agree to consent your real full name, geographic information, a valid email address, to adhere to appropriate conduct, and for us to effectively communicate with you should reason regarding your account arise.

 

 Healthcare Provider Account (also known as 'Remport Account')

When creating a Healthcare Provider Account on our Platform, you hereby agree to consent your real full name, geographic information, billing address, a valid email address and your valid business information to provide you with services rendered and to adhere to appropriate conduct, and for us to effectively communicate with you should reasons regarding your account arise.

 

 

5. SUBSCRIPTION AND CANCELLATION TERMS FOR REMPORT AND MATERIA FACTION

MONTH TO MONTH


Subscription Terms

Your subscription begins as soon as your initial payment is processed. Your subscription will automatically renew each month without notice until you cancel. You authorize us to store your payment method(s) and to automatically charge your payment method(s) every month until you cancel. We will automatically charge you the then-current rate for your plan, plus applicable levies (such as VAT or GST if the rate does not include it), every month upon renewal until you cancel.

We may change your plan's rate each monthly renewal term, and we will notify you of any rate change with the option. If the applicable VAT or GST rate (or other included levy or duty) changes during your one-month term, we will accordingly adjust the levy-inclusive price for your plan on your next billing date.

If your primary payment method fails, you authorize us to charge any other payment method in your account. If you have not provided us a backup payment method(s) and you fail to provide payment, or if all payment methods in your account fail, we may suspend your subscription. You can edit your payment information in your Profile Management page.



Cancellation Terms

You can cancel your subscription anytime via your Profile Management page or by contacting Customer Support. If you cancel within 14 days of your initial order, you'll be fully refunded. Should you cancel after 14 days, your payment is non-refundable, and your service will continue until the end of that month's billing period.

 

ANNUAL CONTRACT, PREPAID

Subscription Terms

Your subscription begins as soon as your initial payment is processed. You will be charged, in one lump sum, the annual rate stated at the time of purchase, plus applicable taxes. Your subscription will automatically renew on your annual renew date until you cancel. You authorize us to store your payment method(s) and to automatically charge your payment method(s) every year until you cancel. 

We will automatically charge you the then-current rate for your plan, plus applicable levies (such as VAT, HST or GST if the rate does not include it), every year upon renewal until you cancel. We may change your plan's rate each annual renewal term, and we will notify you of any rate change with the option to cancel. If the applicable VAT, HST or GST rate (or other included levy or duty) changes during your one-year term, we will accordingly adjust the levy-inclusive price for your plan mid-term on your next billing date. 

If you primary payment method fails, you authorize us to charge any other payment method in your account. If you have not provided us a backup payment method(s) and you fail to provide payment, or if all payment methods in your account fail, we may suspend your subscription. You can edit your payment information anytime in your Profile Management page.

 

Cancellation Terms

Your trial starts immediately after sign-up. At the end of your trial, your subscription begins, and we will automatically charge your payment method at the rate stated at the time of trial sign-up, including any applicable levies, on a recurring basis in accordance with the terms of subscription. Your eligibility to use a Remport and or Materia Faction trial is determined solely by us. Your access to any trial is provided at our sole discretion. 

Your subscription will automatically renew on your annual renewal date until you cancel. You authorize us to store your payment method(s) and automatically charge your payment method(s) every month of your annual contract until you cancel. We will automatically charge you the then-current rate for your subscription, plus applicable levies (such as VAT, HST, or GST if the rate doesn't include it), every year until you cancel. We may change your subscription's rate each annual renewal term, and we will notify you of any rate change with the option to cancel. If the applicable VAT, HST or GST rate (or other included levy or duty) changes during your one-year term, we will accordingly adjust the levy-inclusive price for your subscription mid-term on your next billing date.

We do our best to ensure that the information provided by you is accurate and secure. Personal information is kept only for so long as is required, in accordance with legal and regulatory requirements. Please refer to our Privacy Policy for further information on security and retention of personal data.

 

 

7. USE BY MINORS

Our website and services are not directed at individuals under the age of fourteen (14), and we request that they do not provide their Personal Data through the Services and Platform. If you are a parent or guardian and believe your child has provided us with Personal Data without your consent, please contact us by using the information in Section 10 below and we will take steps to delete their Personal Data from our systems. Members under the age of eighteen (18) may be required to provide guardian consent for age-restricted activities, seminars, and other materials.



8. LINKS TO OTHER WEBSITES

The Platform and Services may provide the ability to connect to other websites. These websites may operate independently from us and therefore may have their own privacy policies or notices, which you are responsible to review. We are not responsible for websites that are not owned or controlled by us, including any matters of Personal Data issues that happen on their end.
